An agreement between the Jackson County Department of Health and EBCI Public Health has created a unique conundrum. The agreement is renewed every three years and updated if needed. At issue is a three foot deep infinity swimming pool, at Harrah’s Casino, which the state of North Carolina does not allow. However, following an inspection it was learned the pool had been built anyway, officials said. The board is expected discuss approving an MOA without addressing the infinity pool and said they’d speak to lawyers about drafting a second document that exempts the county from inspecting the pool, since EBCI lands are soverign, that way it protects Jackson County from liability issues.
